Alan Phillips of our office was engaged to act for his client in the second half of 2023. She had at that time some 10 pages of criminal history including 30+ breaches of bail on her history. She had also been recently sentenced for contravening orders in relation to digital devices and a number of other drug offences. His client was charged with possessing dangerous drugs (19g) and other offences including possession of a rifle. Alan Phillips prepared for and represented his client in the Supreme Court and secured her release on bail.
Whilst on bail for that matter, in early 2024, his client was charged with being a party to an armed robbery with a shotgun. She was bailed again.
She was then charged in mid 2024 with trafficking in dangerous drugs whilst subject to those two bails, and possession of some further 20 grams of methamphetamine. Alan Phillips of our office conducted a thorough analysis of the evidence relating to the trafficking charge, and instructed subpoenas to be issued to confirm the veracity or otherwise of assertions made by police in the bail objection. Those investigations by our office led to other explanations for the allegations, which weakened the Crown case.
Following extensive submissions about the evidence of the offences subject to Supreme Court bail, the weaknesses in the case for the armed robbery, as well as the lack of evidence in relation to the drug trafficking, the defendant was granted bail on strict conditions including regular reporting, and a $5,000.00 cash surety.
Trafficking in dangerous drugs now carries a maximum penalty of life imprisonment.
