Alan Phillips of our office instructed Scott Lynch of Counsel in a sentence before the Brisbane District Court in late 2020.
Our client was co-accused with another offender. Both were sentenced in relation to 11 years of cannabis trafficking. The two defendants resided together. A search warrant was executed and millions of dollars of cash was found, along with other artifacts and expensive property that police alleged were the proceeds of drug trafficking.
Our client was an elderly lady. She accepted her role in the trafficking by assisting her co-offender in his business, but denied knowledge of, or having a share in the money and other items found by police.
The matter proceeded to a contested sentence as the prosecuting office did not accept our client's position. Our client gave evidence that she had no knowledge of the items. The sentencing Judge accepted our client's version and found that her profit from the business was limited.
The offending was still very serious due to the long period of offending. Due to our client's age and rehabilitation since the offending, the sentencing Judge imposed a sentence of 5 years imprisonment, wholly suspended for an operational period of 5 years.
