Alan Phillips of our office instructed Scott Lynch of Counsel in the Supreme Court of Queensland for our client who pleaded guilty to drug trafficking.
Our client was 25 years of age at the time he was trafficking in dangerous drugs. He, like every adult trafficker, was expecting actual time in custody. He had no history. The Crown submitted he ought receive 4 to 5 years of imprisonment, to serve between a quarter and a third of that in actual custody.
Submissions were made that our client had unusual circumstances which warranted special leniency in his case. He was not charged for some 17 months after police seized his phone, he was supported in Court by a large number of friends and community, and his actions in the community since the offending were demonstrative of his change in character since the offending.
His Honour stood the matter down after hearing submissions, as he was undecided on what course to take. He ultimately formed the view that the unique circumstances of this case allowed him to sentence the defendant to 4 years imprisonment, wholly suspended.
Trafficking in dangerous drugs carries a maximum penalty of life imprisonment.
